Plaintiff instituted this action against the defendant Flittie and A. Moriarty, as receiver of the Interstate Surety Company, a corporation, to recover upon money demand. *527The complaint alleges the capacity of plaintiff as a public corporation; the election and qualification of defendant Flittie as treasurer of plaintiff; the execution of his official bond as such treasurer by Interstate Surety Company; apt allegations as to the appointment of the defendant Moriarty as receiver of said Interstate .Surety Company; filing of a claim with the receiver; leave of court to sue the receiver, etc.;…
