Kenneth Augustine appeals his convictions for three counts of third degree assault, three counts of unauthorized use of an unlicensed firearm during the commission of a third degree assault, and one count of reckless endangerment in the first degree arising from an alleged shootout with three police officers. On appeal he challenges the sufficiency of the evidence, argues that he was improperly convicted of the three counts of third degree assault, and claims that he was denied a fair trial.
