Appeal from a judgment of the Supreme Court (Nolan, Jr., J), entered April 3, 2009 in Saratoga County, which, in a combined proceeding pursuant to CPLR article 78 and action for declaratory judgment, granted respondents’ motion for summary judgment dismissing the petition/complaint.
