Error from Wyandotte District Court. Action brought by Thompson and another, partners, against Irwin and two others, partners, upon an implied warranty of title in the sale of certain cattle. Trial at the April Term, 1881, of the district court, and judgment for plaintiffs for $683.56, and costs. The defendants bring the case here. The facts appear in the opinion.

This was an action in the district court of Wyandotte county, on an implied warranty of title in the sale of cattle. The case was tried before a jury; verdict and judgment were entered in favor of the plaintiffs, and to review this ruling the defendants allege error.

No question is raised upon the pleadings, none as to the instructions, and the single proposition of counsel for plaintiffs in error is, that under the law as stated by the court the testimony did not warrant the verdict. Counsel for defendants in error, plaintiffs below, in…
