This is a suit brought by the Texas Improvement Company, a corporation organized under the laws of this State, against John S. Steely, to recover $2,500 alleged to be due upon a subscription for stock in the concern made by him before the company was organized,
The defendant answered by general and special exceptions to plaintiff’s petition, a general denial, and a special plea that he had withdrawn his subscription before the corporation was organized.
The case was tried by the court without a jury, and judgment was rendered in plaintiff’s favor for the amount sued…
