Appellant sued in the district court of Potter county, filing its amended petition August 7, 1912, in which it is alleged that R. L. Stringfellow, the deceased husband of appellee, had subscribed for 25 shares of the capital stock of appellant, of the par value of $2,500; that by the terms of the subscription contract, upon demand of the executive committee of the subscribers of stock, 50 per cent, of each subscription should be paid to said committee, and the-remaining 50 per cent, of such subscription upon demand of the board of directors of appellant company, if the same should…
