Plaintiff Carl J. Buscemi brings this age discrimination action against defendant PepsiCo, Inc. 1 pursuant to the Federal Age Discrimination in Employment Act (“ADEA”), 29 U.S.C. §§ 621 (1985) et seq., and the New York Human Rights Law, N.Y.
