This case comes to this Court on appeal from the Circuit Court of Hinds County. On May 18, 1988, the appellee, Joan C. Collins, an employee of the Mississippi Employment Security Commission (the "MESC"), filed a grievance with the Mississippi Employee Appeals Board (the "EAB"), alleging that she had been passed over for promotions due to her age and handicap. A hearing was held before the EAB and on September 23, 1988, an order was issued instructing the MESC to promote Collins to the next available position for which she was qualified.
