The issue before this court is whether the referee, acting as a court, erred in granting the defendants’ motion to release in part a lis pendens for reasons other than those set forth by statute.

An action, pursuant to which this appeal arose, was instituted in August, 1963, for breach of contract on the part of various defendants arising from their purchase of certain real estate of the plaintiff.
