This action under the workmen’s compensation act was brought by Rosa Finck, mother of Jesse Owen Towles, deceased, and Robert Finck, his stepfather, for compensation as partial dependents. Compensation was denied because the commission and the district court each held that the injury did not arise out of the employment in which Towles was engaged when he was killed. The plaintiffs appeal.
