ERNEST F. COCHRAN, District Judge.

The appellant, who will hereinafter be styled the plaintiff, a citizen of West Virginia, filed his suit in a state court of West Virginia against the appellees, who will hereinafter be designated the defendants. The defendant Norfolk & Western Railway Company is a corporation of Virginia, and the defendant Robert P. Compton, a conductor, and the defendant John Knight, a brakeman, in its service, are citizens of West Virginia. The case was removed to the District Court of the United States.
