Petitioner brought this mandate proceeding to set aside the order of respondent board revoking his license to practice optometry.

An accusation was filed with the board charging petitioner with three counts of unprofessional conduct, viz: (1) employment of “cappers” or “steerers” to obtain business (Bus. & Prof. Code, § 3100); (2) obtaining fees by fraud or misrepresentation (Bus. & Prof. Code, § 3101); and (3) payment of unearned rebates as inducement for referring patients (Bus. & Prof. Code, § 650).
