On October 24, 1989, we dismissed this appeal, finding that the federal courts exercise exclusive jurisdiction over cases based upon violations of the Petroleum Marketing Practices Act (PMPA), 15 United States Code section 2801 et seq. Defendant/Cross-complainant/respondent Patrick M. O’Riley successfully petitioned the United States Supreme Court for writ of certiorari. The United States Supreme Court vacated our earlier judgment and remanded the cause to us for further consideration in light of Tafflin v.
