This appeal stems from the contamination and subsequent clean up of an area popularly known as Sullivan’s Ledge, located in New Bedford, Massachusetts. Plaintiffs-appellants, collectively known as the Sullivan’s Ledge Group, are thirteen corporations which received notices from the U.S. Environmental Protection Agency (“EPA”) advising that the government considered them responsible for the pollution of Sullivan’s Ledge under the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (“CERCLA”). 1 In the early 1990’s, the group entered into…
