OPINION OF THE COURT
GREENBERG, Circuit Judge.
This matter is before the court on appeal by Alcan Aluminum Corporation (“Alcan”) from a summary judgment entered in favor of the United States (the “Government”) for response costs incurred by the Government in cleaning the Susquehanna River.
On November 24, 1989, the Government filed a complaint in the United States District Court for the Middle District of Pennsylvania under section 107(a) of the Comprehensive Environmental Response, Compensation and Liability Act, 42 U.S.C. § 9607(a) (“CERCLA”) against 20 defendants, including Alcan, for the…
