On the day of his death, the decedent had attended Superior Court in Portsmouth as a deputy sheriff. His wife, the plaintiff, accompanied him on the trip in his automobile. Because a fog set in, they started early for their home in Londonderry, doing some errands on the way. At about seven in the evening, after dark, the decedent came opposite his unlighted house, which was north of the road and to his right.
