This was an action of detinue, brought by G. S. McFadden against James Crawford in the Circuit Court of Marshall county on the 31st day of August, 1889, to recover two railroad spike machines, of the alleged value of five hundred dollars each. The defendant demurred to the plaintiff’s declaration, which demurrer was overruled.
