This matter comes before the court pursuant to the defendant’s April 15, 1998 motion for summary judgment (docket number 21). The parties have consented to the exercise of jurisdiction by a United States Magistrate Judge pursuant to 28 U.S.C. § 636(c). The court held oral argument on this motion on May 29, 1998, at which the plaintiff was represented by Matthew Glasson. The defendant was represented by Wilford Stone.
