FIRESTONE, Judge.

Defendant, United States (“government”), has moved for summary judgment with respect to all of the plaintiffs’ claims for monetary relief in this Winstar-related case, including all of plaintiffs’ remaining causes of action for restitution, rescission and a government taking under the Fifth Amendment of the United States Constitution. United States v. Winstar Corp., 518 U.S. 839, 116 S.Ct. 2432, 135 L.Ed.2d 964 (1996).
