In this Winstar-related1 case, defendant, United States (“government”), moved on De*737cember 2,2003 to dismiss plaintiffs’ breach of contract claims pursuant to RCFC 12(b)(6) for failure to state a claim upon which relief can be granted. Oral argument was held on February 5, 2004. Thereafter, the Court ordered that the parties engage in supplemental briefing to address and clarify certain issues raised at oral argument.
