This action was commenced by the defendant in error, plaintiff below, on November 20, 1913, to recover damages consisting of the depreciation in value of a tract of land owned and occupied by plaintiff and of the loss of the usable value of said land because of the pollution of a water course by a sanitary sewer erected and operated by defendant. The petition alleges that in June, 1907, the defendant wrongfully and unlawfully, and without plaintiff’s consent and over his protest, erected and constructed a sanitary sewer system for the city of Mangum. and emptied the same…
