This case raises novel and important questions relating to appellate review of the sentence adjudged by a court-martial.

On December 1, 1954, the accused was arraigned before a special court-martial on a charge alleging an unauthorized absence of approximately eleven hours. He pleaded guilty and was convicted. During the sentence procedure, trial counsel, read the service -data from the charge sheet and introduced evidence of two previous convictions. Both convictions were by a summary court-martial.
