MEMORANDUM

DURKIN, United States Magistrate Judge.

Before the court is defendants’ motion for judgment on the pleadings or, in the alternative, to dismiss plaintiffs’ complaint for lack of subject matter jurisdiction.

Plaintiffs, former property owners in Great Bend Township, brought this action pursuant to 42 U.S.C. § 1983 against Great Bend Township, H. Douglas Hall, a sewage enforcement officer for the Township and Edmund E. Jones, a secretary for the Township in which they seek damages by reason of defendants’ alleged arbitrary and irrational conduct which lead to the recision of an approval…
