Plaintiff brought his action to recover upon two promissory notes executed by defendant to him. The notes are pleaded in Tiaec verba in the complaint and each provides for the payment “of a reasonable attorney’s fee if suit is commenced to enforce the payment. ’ ’ The total amount due on these notes was twelve thousand two hundred dollars. Defendant answered by pleading a composition agreement whereuñder the notes were to be paid not according to their terms and tenure but at the rate of three thousand dollars monthly.
