MEMORANDUM AND ORDER
LEISURE, District Judge:
Plaintiff Lawrence Alkoff has asserted claims for damages and other relief pursuant to Section 10(b) of the Securities Exchange Act of 1934 (the “1934 Act”), 15 U.S.C. § 78j(b), Rule 10b-5 promulgated thereunder, and 18 U.S.C. §§ 1961-68, known as the Racketeer Influenced and Corrupt Organizations Act (“RICO”). In addition, plaintiff has asserted pendent claims for fraud, duress, mistake, and New York Business Corporation Law violations and seeks rescission, constructive trust and an accounting under New York common law.
