This is an action to recover upon a broker’s bond for $5,000, issued in accordance with the requirements of subdivision 3 of section 6 of the Corporate Securities Act, as amended (Stats. 1931, p. 944). The action involves three transactions had by the plaintiff and cross-complainants, respectively, with the brokerage firm of W. P. Smith & Company, for which firm the corporate defendants had furnished the bond in question. The trustee of the bankrupt estate of W. P.
