Plaintiff was awarded judgment, for the recovery of a stock certificate representing certain corporate-shares, and defendant has appealed therefrom.

On the 13th of May, 1918, R. A. Moore was the owner of 1,900 shares of the capital stock of the Grant Tool Company. On that day he deposited a certificate representing the full number of shares mentioned with a banking corporation, for the purpose of having the same held in escrow subject to conditions which he stated in writing.
