This case comes before this court upon an agreed case under section 1138, Code of Civil Procedure. The facts agreed on are as follows: On the 8th of May, 1882, John J. Handley, Jr., and Catharine Handley were the owners in fee-simple and in possession of a lot of land situate in the city of Santa Cruz, known as lot five (5), in block Ho. two (2), and on that day executed a mortgage on the same, with other property, to the Santa Cruz Bank of Savings and Loan, as security for the payment of the sum of eighteen hundred dollars, maturing on the eighth day of May, 1885, with interest at…
