By Opinion & Order dated October 16, 2007 (the “Order”), the Honorable Kenneth M. Karas, District Judge, granted defendants’ motion for summary judgment, leaving only defendants’ counterclaims to be tried. The case was thereafter reassigned to the undersigned.
