Since the beginning of 1999, this court has received 31 petitions for interlocutory appeal under 28 U.S.C. § 1292(b) and has granted only six of them. The majority have been denied or dismissed for jurisdictional reasons but seven have been denied even though the district judge had certified that the order sought to be appealed “involves a controlling question of law as to which there is substantial ground for difference of opinion and that an immediate appeal from the order may materially advance the ultimate termination of the litigation,” which is the statutory…
