PARKER, Justice.

Defendant was indicted for the first-degree murder of Erik R. Tornblom in violation of N.C.G.S. § 14-17 and was tried capitally. The jury first found defendant not guilty of premeditated murder, guilty of felony murder based on robbery with a firearm, guilty of first-degree kidnapping, not guilty of robbery with a firearm, guilty of possession of a weapon of mass destruction, guilty of possession of a stolen vehicle, and not guilty of felonious larceny.
