This was an action to recover $22, money had and received on an assignment of wages not collected. The action was commenced before a Justice of the Peace, and appealed to the circuit court, and the case was there tried by the judge without a jury, and resulted in a judgment for the defendant below. The trial court overruled a motion for a new trial, and the plaintiff has appealed in error to this court, and has assigned- three errors, as follows r

“1. Because there was no evidence to support the verdict.
“2. Because the court erred in holding that a plea of infancy was good.
