OPINION AND ORDER ON DEFENDANT’S MOTION TO DISMISS
WHEELER, Judge.
In this action, pro se Plaintiff Louis J. De Maio asserts that his former employer, the Internal Revenue Service (“IRS”), wrongfully terminated his employment and engaged in criminal conduct by refusing to enroll him in the Federal Employees Health Benefits (“FEHB”) program following his removal. Mr. De Maio requests the Court to reinstate him to “civil service status” with the IRS and to re-enroll him in the FEHB program.
