Appeal from Oakland; Murphy, J., presiding. Bill by William H. Loomis against Eugene Mack, trustee, and others, for the construction of a will. From a decree sustaining the trust created by the instrument, complainant and certain defendants appeal.

The bill filed in this cause asks for the construction of the will of Leonard Rowland, who died in March, 1909, and prays that the fourth clause thereof may be decreed to be invalid. The fourth clause creates what is called a charitable trust for the benefit of dependent children in Oakland county between the ages of 12 and 14 years. The estate con*675sists of both real and personal property. It is conceded that the provision must fail unless it is saved by, and the trust created can be administered under, Act No. 122, Public Acts of 1907 (4 How. Stat.
