SIMONS, Circuit Judge.

' The bill attacks the validity under Michigan law of certain charitable trusts created by the will, and codicils thereto, of Charles F. Ruggles, of Manistee, Mich., who died August 21, 1930. Appellant, plaintiff below, is a citizen of Illinois, and as trustee is an assignee of certain of the heirs at law of the deceased. Appellees, defendants to the suit below, are the executors and trustees under the will, and are citizens of Michigan.
