MOSMAN, District Judge.

In this breach-of-contract action plaintiff Legacy Wireless Services, Inc. (“Legacy”) filed a petition to compel arbitration under the Federal Arbitration Act. Defendant Human Capital, L.L.C. (“Human Capital”) responded with a motion to dismiss Legacy’s petition. Human Capital argues that the court lacks subject matter jurisdiction because complete diversity does not exist.
