Error to Presque Isle; Emerick, J. Case by John Mushinski, by next friend, against Vincent D. Vincent, for personal injuries. From a judgment for defendant on verdict directed by the court, plaintiff brings error.

The plaintiff, who was at the time 19 years of age, was employed in the defendant’s sawmill. He had worked in the same position , two days under an earlier employment, and on a second employment had worked during the afternoon of May 22, 1900, and until 9 o’clock the next day, when he received the injuries in question. A description of the sawmill and the manner of the accident is as follows: The saw carriage runs east and west on a track, as is usual in such mills.
