I. INTRODUCTION

This matter is before the court on the defendant’s motion to dismiss for lack of subject-matter jurisdiction pursuant to Federal Rule of Civil Procedure 12(b)(1). The plaintiff, Ms. Terree Battle (the “plaintiff’ or “Ms. Battle”), brought this suit for declaratory and injunctive relief and damages under Title VII of the Civil Rights Act of 1964, as amended, 42 U.S.C. § 2000e et seq.
