MEMORANDUM OPINION AND ORDER
RICHARD W. ROBERTS, District Judge.
Plaintiff Tommy J. Winston, an employee of the Smithsonian Institution (“Smithsonian”) filed a three-count complaint against the Secretary of the Smithsonian, 1 seeking damages under Title VII of the Civil Rights Act of 1964, 42 U.S.C. 2000e et seq., for discrimination based on race and color, for retaliation, and for a hostile work environment.
