Appellant was tried by members at a general court-martial. She was convicted of three specifications of assault and one charge of “child neglect,” in violation of Articles 128 and 134, Uniform Code of Military Justice [hereinafter UCMJ], 10 U.S.C. §§ 928 and 934, respectively. Appellant contested one of the assault specifications and entered a conditional plea on the charge of “child neglect” under Article 134, preserving the issue of whether the charge stated an offense.
