Defendant Thomas G. Wellman, desiring to build a house, had preliminary talks with an architect, Edward W. Barber, the contemplated contractor, Emery Wohlers, and one D. L. Mills, secretary and treasurer of appellant, Lake City Federal Savings and Loan Association, during the early part of 1946. Before he had a deed to the lot on which he proposed to build his house, he told Wohlers, on or about July 20,1946, that everything was all set and that he should go ahead with the work.
