The plaintiff in error, hereinafter called the defendant, was informed against in the district court of Oklahoma county, charged with the crime of assault and battery, with such means and force as likely to produce death; was convicted by a jury of the crime of assault and battery upon the person of Theodore Newcomer with a sharp and dangerous weapon with intent to injure him, and his punishment fixed by the jury at imprisonment in the penitentiary for a period of one year. Motion for a new trial was filed and overruled, and exceptions saved, and defendant has appealed to this court.
