The plaintiff in error, hereinafter called the defendant, was tried for the crime of murder, and convicted of manslaughter in the first degree, and sentenced to he confined in the state penitentiary for a period of four years. Motion for new trial was filed, considered, overruled, exceptions saved, and the defendant has appealed to this court.

The record is voluminous. The testimony on behalf of the state that is deemed necessary to set out is, in substance, as follows:
