In this action plaintiff U.S. Underwriters Insurance Company (“plaintiff’ or “U.S. Underwriters”) seeks a declaratory judgment that it is not required to defend or indemnify defendants 614 Construction Corp. (“614 Construction”), 626 Emmut Properties Ltd. (“626 Emmut”), and Em-mut Properties Corp. (“Emmut”) 1 in an underlying state court action (“the Underlying Action”) brought by defendant Stead-man Wilson (“Mr.Wilson”) for injuries sustained while working on property owned by 626 Emmut.
