MEMORANDUM OPINION AND ORDER

BOYLE, United States Magistrate Judge.

Before the court are three applications for summary judgment, pursuant to Federal Rule of Civil Procedure 56. Plaintiffs, Guy and Mary Palanquet (“plaintiffs”) seek judgment as á matter of law establishing the liability of defendant, Weeks Marine, Inc. (“Weeks”), for violation of Section 240(1) of the New York Labor Law. Weeks and third-party defendant, C.B. Contracting Corp. (“C.B.”), oppose the plaintiffs’ motion.
