This is a mandate action commenced in this court. The State Controller and the Board of Administration of the State Employees’ Retirement System are the respondents.
Nancy Lyon, the petitioner, is the widow of the late Charles W. Lyon, who served as a member of the California Legislature for 34 years. At the beginning of 1955 Mr. Lyon commenced drawing a monthly retirement allowance under the provisions of the Legislators’ Retirement Law (Gov. Code, § 9350 et seq.).
