WEAVER, Justice.

Appellants, Jay Mahlon Hill and Linda Maria Lembo Hill, who are a married couple, were each charged in separate indictments for the offense of injury to a child by omission. See TexPenal Code Ann. § 22.04 (Vernon Supp.1994). The indictments alleged that each appellant “intentionally and knowingly, by omission, [caused] disfigurement and deformity, serious bodily injury, and serious physical and mental deficiency and impairment to Stephen Hill, a child younger than fifteen years of age, by failure to provide food and medical care” to Stephen when they had a legal duty as…
