On June 17,1957, plaintiff and appellant, county of Kings, filed an action against defendants and respondents, Allie Mae Scott (hereinafter referred to as defendant) ; Mary Sweeney, guardian of the estate of Allie Mae Scott, an incompetent person; and Charles W. Puckett; alleging that the defendant Allie Mae Scott was indebted to, and would become further indebted to the plaintiff on account of hospital care rendered and to be rendered by the plaintiff to the defendant at the request of the defendant.
