Before this court is defendant’s motion to dismiss plaintiff’s pro se complaint1 pursuant to Rules 12(b)(1) and 12(b)(6) of the Rules of the United States Court of Federal Claims (“RCFC”). In a January 28, 2005 order, the United States District Court for the Central District of California (“district court”) transferred plaintiff’s complaint to this court.
