OPINION
HARKINS, Judge.
The issue presented by cross-motions for summary judgment in this case is whether plaintiff’s dissolution under Delaware corporation law on June 21, 1976, and the expiration of the statutory 3-year winding up period, eliminated plaintiff’s capacity under USCCR 17(b) to sue or be sued on claims defined in a final decision of a contracting officer made July 15, 1980, pursuant to the disputes clause of a contract that was executed on April 15, 1968.
